Terms of Service

These Terms of Service ("Terms") govern your use of FlyAtlast, a flight price-tracking and price-monitoring service operated by 2658023 Ontario Inc. under the name FlyAtlast ("we," "us," "our"). By creating an account or using FlyAtlast, you agree to these Terms.

1. What FlyAtlast does

FlyAtlast tracks flight prices you choose to follow ("pins") and notifies you when a price meets your stated budget. FlyAtlast is an informational and price-monitoring tool. It is not a travel agency, and it does not sell or issue flight tickets. Prices shown reflect what we found during our periodic checks and may not match the price available if and when you book through a third-party provider. We may earn a commission from booking partners at no extra cost to you.

2. Price Watch

Price Watch is an optional, paid feature that monitors one of your tracked trips more closely for a set period. It is available once a trip's tracked price is at or under your budget and its departure is at least 24 hours away. Two durations are offered: 48 hours for $5.99 USD, or 5 days for $9.99 USD. The fee is converted to your trip's currency at the exchange rate on the day you start the watch, and the converted amount is shown before you confirm. Fees do not include GST/HST or any other applicable taxes, which are added on top where they apply.

Trial Price Watch

Each account may use one trial Price Watch. The trial runs for 24 hours, requires no card, and is never charged regardless of how the tracked price moves. It otherwise works the same as a paid watch: the same 2-hourly checks and the same comparison described below, except the result is informational only.

What happens when you start a Price Watch

• We record the tracked price at that moment (your "starting price") and place a temporary authorization hold for the fee on your card. This is not a charge. (The trial Price Watch places no hold, since nothing is ever charged.)
• We check the price for that trip about every 2 hours for the length of the watch. We stop checking 12 hours before departure; if that comes before the watch would normally end, the watch ends at that point instead.

How the result is decided

When the watch ends, we compare the live tracked price to your starting price:

• If it is higher by $5 USD or more, or lower by $20 USD or more (each converted to your trip's currency), the hold is released and you are not charged.
• Otherwise, the held fee is charged. The fee pays for the monitoring provided during the watch.

Only the comparison at the end of the watch decides the result. Price movements during the watch that reverse before it ends do not change the outcome.

Booking-price refund

If your fee was charged, you may submit a booking confirmation within 48 hours after it ends. We review it and, if it shows you paid more than your starting price, we will refund the full fee. Documents that are unclear, for a different trip or in a different currency may take longer or be declined.

Cancellation

You may cancel a 5-day Price Watch within 24 hours of starting it, or a 48-hour Price Watch within 12 hours of starting it. A cancelled watch releases the hold and is not charged. The trial Price Watch cannot be cancelled through the app, since nothing is ever charged on it.

What happens once a Price Watch ends

Once a Price Watch reaches a result, including a trial Price Watch, the trip it was tracking stops being monitored and is removed from your active pins, freeing up a tracking slot. If a fee was charged, the trip remains visible for up to 48 hours so you can submit a booking-price refund request as described above; otherwise it moves immediately into your trip history. A trip that has finished a Price Watch cannot be edited or restarted. You would pin it again as a new trip.

What Price Watch is not

Price Watch does not reserve, hold, or purchase any seat or fare, and it does not guarantee that any price will be available when you book through a third-party site. If the price rises, you would pay the higher price when you book. FlyAtlast's responsibility in connection with a Price Watch is limited to the fee described in this section.

3. Trip limits and extra trips

Each account can track a set number of trips at a time, and create a set number of trips in total. Deleting a trip doesn't give that trip back. You can get more room by earning rewards (like a check-in streak or a referral) or by buying extra trips ("pin bundles"). Pin bundle purchases are one-time charges, not subscriptions. They can't be refunded once the extra trips are added to your account.

4. Payment processing

When FlyAtlast charges a fee, payment is processed by Stripe, Inc., a third-party payment processor. FlyAtlast does not collect, see, or store your full card number. By making a purchase, you also agree to Stripe's own terms of service. If you dispute a charge with your bank or card issuer, we may suspend your account while the dispute is resolved and share the information needed to respond with our payment processor.

5. Accounts

You must provide accurate information when creating an account and are responsible for keeping your login credentials secure. You must be at least 18 years old, or the age of majority in your jurisdiction, to use FlyAtlast.

6. Referral program

FlyAtlast may offer bonus tracking slots or other incentives for referring new users. Referral rewards are granted at FlyAtlast's discretion and may be modified or discontinued at any time. Self-referrals and fraudulent referral activity are not eligible for rewards.

7. Limitation of liability

To the maximum extent permitted by law, FlyAtlast's total liability to you for any claim arising from your use of the Service, including any Price Watch, is limited to the total amount you paid to FlyAtlast in the 12 months before the claim arose. FlyAtlast is not liable for indirect, incidental, or consequential damages, including the difference between a tracked price and the price you actually paid, lost bookings, or missed travel opportunities.

8. No guarantee

We do not guarantee that price checks will occur at any specific frequency, that tracked prices will be accurate or available at the time of booking, or that the Service will be uninterrupted or without errors.

9. Prohibited conduct

You agree not to misuse the Service, including attempting to access another user's account, interfering with the Service's normal operation, or using the Service for any unlawful purpose.

10. Termination

We may suspend or terminate your account for violation of these Terms. You may stop using FlyAtlast and delete your account at any time. Deleting your account ends any Price Watch you have running at that moment: we run the same comparison described in Section 2 immediately, using the live price at that moment rather than waiting for the watch's normal end time, and the fee is charged or the hold released based on that result, the same as it would be for any other watch. Your account and its data are held for 30 days after deletion, during which a recovery request can be made by contacting us, and are then permanently removed.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of FlyAtlast after changes take effect constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles.
